:: Standard Guarantee Terms
My Go Ltd offers a limited, non-transferable 12 Month Return to Base Guarantee “Standard Guarantee” to all of My Go Ltd products. Any product is guaranteed to be free from defects in both components and workmanship under regular uses defined in user manuals during the Guarantee period. The “Standard Guarantee” is limited to 6 months for items included with the main purchase product: including but not limited to memory cards and other media, headphones and cables, docking stations, rechargeable batteries (internal or removeable), external power adapters/chargers and remote controls. The Guarantee period commences on the date of purchase.
Attention: Your original Purchase invoice (sales receipt) showing the date of purchase, model number and serial number of the product is your proof of the date of purchase.
If a My Go Ltd (“My Go”) product is defective My Go provides the following Terms and Conditions which may be provided in addition to your statutory rights, but do not affect your statutory rights:
for products purchased in the UK: the Sale of Goods Act 1979, the Supply of Goods and Services Act 1982 and the Sale and Supply of Goods to Consumers Regulations 2002.
for products purchased in Ireland: the Sale of Goods Act, 1893, the Sale of Goods and Supply of Services Act,1980 and the European Communities (Certain Aspects of the Sale of Consumer Goods and Associated Guarantees) Regulations 2003 (S.I. No. 11/2003);
Product Guarantee
During the Guarantee period, the defective hardware parts of claimed My Go Ltd products will be either repaired or replaced at the discretion of My Go Ltd except in the cases listed in the Limitation of Liability Clause of this document.
This International Limited Guarantee covers the costs of service parts and labor required to restore your product to fully functional condition. My Go Ltd will, at its discretion, repair or replace any defective products or parts thereof covered by this International Limited Guarantee with new or refurbished parts of the product that are equivalent to new products in both functionality and performance. A product or part that is repaired or replaced under this International Limited Guarantee shall be covered for the remainder of the original Guarantee period applying to the product or part, or for six months, whichever expires last. All exchanged parts and products under this International Limited Guarantee will become the property of My Go Ltd.
WHAT IS COVERED BY THIS GUARANTEE?
My Go Ltd (“My Go”) warrants the My Go Product and Accessories (including but not limited to GoTab, GoFone, GoNote, GoBook, GoTV, GoMax, GoFit, GoCam,) contained in the original packaging (“My Go Product”) against defects in materials and workmanship when used in accordance with My Go’s user manuals, technical specifications and other My Go Product published guidelines for a period of ONE (1) YEAR from the date of original retail purchase by the end-user purchaser unless otherwise stated during the contract of sale (“Guarantee Period”) .
Technical Support Services
My Go provides support and assistance to customers covering system, fault and damage questions, based on the description of the service that you order (each a “Service”). My Go will provide access to one or more support specialists during the Guarantee period. Support will be provided via telephone, chat, remote session, or in person, during normal business hours or at other times at My Go’s discretion.
My Go will use commercially reasonable efforts to assist you during the service incident for the specific Service you have purchased. However, not all problems can be diagnosed or corrected easily, and some may require you to return your computer to its original state, reload the operating system, application software, reload your personal settings and data, or work with a third party hardware or software vendor to resolve the problem.
WHAT WILL MY GO DO IN THE EVENT OF A GUARANTEE CLAIM?
If you submit a valid claim under this Guarantee, My Go will, at its option:
(i) repair the My Go Product using new or previously used parts that are equivalent to new in performance and reliability, or
(ii) replace the My Go Product with a product that is at least functionally equivalent to the My Go Product and is formed from new and/or previously used parts that are equivalent to new in performance and reliability, or
(iii) refund your purchase price in exchange for the return of your My Go Product.
When a product or part is replaced or a refund provided, any replacement item becomes your property and the replaced or refunded item becomes My Go’s property.
A replacement part or product or a repaired My Go Product assumes the remaining Guarantee of the original My Go Product or ninety (90) days from the date of replacement or repair, whichever provides longer coverage for you.
Before receiving Guarantee service, My Go or its agents may require that you furnish proof of purchase details, respond to questions designed to assist with diagnosing potential issues and follow My Go’s procedures for obtaining Guarantee service, such as following instructions for packing and shipping My Go Products when receiving Mail-in service as described below.
If, through our negligence or wilful misconduct, we damage the Equipment beyond economical repair, our liability will be limited to the cost of providing a replacement with a product that is the same as or similar to the Equipment.
WHAT IS NOT COVERED BY THIS GUARANTEE?
This Guarantee does not apply to any non-My Go branded hardware products or any software, even if packaged or sold with My Go hardware. Non-My Go branded products may have the benefit of a manufacturer’s Guarantee, which provides benefits in addition to consumer law rights – please check your product box and literature for details.
Service options may be limited if requesting service in a country that is not the country of purchase for the My Go Product. In the event that service for the My Go Product is not available in such country, My Go will notify you of any additional charges for shipping and handling that may apply before rendering service.
When contacting My Go via telephone, call charges may apply depending on your location. Please contact your network operator for details.
This Guarantee does not apply:
(a) to consumable parts, such as batteries or protective coatings that are designed to diminish over time, unless failure has occurred due to a defect in materials or workmanship;
(b) to cosmetic damage, including but not limited to scratches, dents and broken plastic on ports;
(c) to damage caused by use with another product;
(d) to damage caused by accident (including smashed or cracked screens / displays) , abuse, misuse, liquid contact, fire, earthquake or other external cause;
(e) to damage caused by operating the My Go Product outside the user manual, the technical specifications or other My Go Product published guidelines;
(f) to damage caused by service (including upgrades and expansions) performed by anyone who is not a representative of My Go or an My Go Authorized Service Provider;
(g) to an My Go Product that has been modified to alter functionality or capability without the written permission of My Go;
(h) to defects caused by normal wear and tear or otherwise due to the normal aging of the My Go Product; or (i) if any serial number has been removed or defaced from the My Go Product, or
(j) if the product is stolen or My Go reasonably believes that the product is stolen based on information provided by law enforcement authorities.
(k) to Out of Guarantee Repairs
If your product is experiencing functional issues and is no longer within the Guarantee period, My Go may, at its option, and for a fee, agree to repair your product. All Out of Guarantee Repairs must be agreed beforehand with My Go Technical Support Staff, or authorised agent, and be shipped to the My Go facility with accompanying Repairs Authorisation documentation (this will be given to you by the My Go Technical Support Staff, or authorised agent) . The consumer is responsible for shipping the product to our facility, including all costs and expenses of transportation. My Go will return your product back to you at My Go’s cost and expense. Except for credit or debit card transactions, amounts are due upon receipt of invoice from My Go. You agree to pay as specified by My Go in the invoice, including any applicable sales, use or similar taxes, fees or duties (unless you supply exemption documentation), and any late payment fees. No other discounts, quantity entitlements, or promotions apply unless expressly specified for this transaction.
The repair price quoted by our system is an estimate only, based on the information you have provided. It is possible that the price to repair the unit is higher than the estimated price (for example, if the information provided was inaccurate, or if your unit has other faults). On these occasions you will be contacted via email or phone to authorise a new repair quotation.
Units will be held for a maximum of 30 days after they are either repaired, deemed beyond economical repair or requiring a requote. We will make reasonable attempts to contact you by phone and email a minimum of 3 times. If you have not made payment within 30 days, the unit will be auctioned to recover our costs.
A product that is inoperable due to unauthorized modifications or has failed due to catastrophic damage, such as the product separating into multiple pieces, are examples of a product that is eligible for Out of Guarantee Service.
Out of Guarantee Repairs are covered by a ninety (90) day Guarantee applying to the repair work completed, commencing on the day of Payment for the Out of Guarantee Repair.
(l) to Customer-induced Damage (CID) Repair
If your product has been damaged by Customer-induced Damage (CID) (whether it is within the Guarantee period or not), My Go may, at its option, and for a fee, agree to repair your product. All Customer-induced Damage (CID) is not covered by this Guarantee. All Customer-induced Damage Repairs must be agreed beforehand with My Go Technical Support Staff, or authorised agent, and be shipped to the My Go facility with accompanying Repairs Authorisation documentation (this will be given to you by the My Go Technical Support Staff, or authorised agent) . The consumer is responsible for shipping the product to our facility, including all costs and expenses of transportation. My Go will return your product back to you at My Go’s cost and expense. Customer-induced Damage (CID) Repair are covered by a ninety (90) day Guarantee applying to the repair work completed, commencing on the day of Payment for the Customer-induced Damage (CID) Repair.
Customer-induced Damage (CID) includes, but is not limited to; Digitiser (TouchPanel) smashed or cracked, LCD/TFT Display Damaged, PCB Trace Scratched, PCB Broken, Damaged capacitors, resistors, inductors, small passive components, socket, etc., PCB & Component Oxidation, PCB Burned, Component Burned, Missing Component, Dirt, S/N Label Damaged, Liquid Damage, Damage caused by act of nature, such as fire, flood, wind, earthquake, lightning, etc.
My Go warrants that it will perform Services using reasonable care and skill. My Go does not warrant that My Go will be able to correct all problems.
Your right to use the Guarantee is not transferable. You may not use the Services in connection with any sharing arrangement, on behalf of any third-party or with respect to any device not owned by you or software program not installed on devices owned by you.
YOUR RESPONSIBILITIES
IF YOUR MY GO PRODUCT IS CAPABLE OF STORING SOFTWARE PROGRAMS, DATA AND OTHER INFORMATION, YOU SHOULD MAKE PERIODIC BACKUP COPIES OF THE INFORMATION CONTAINED ON YOUR MY GO PRODUCT’S STORAGE MEDIA TO PROTECT THE CONTENTS AND AS A PRECAUTION AGAINST POSSIBLE OPERATIONAL FAILURES.
Before submitting your My Go Product for Guarantee service you should make separate backup copy of the contents of its storage media, remove all personal information and disable all security passwords. The contents of your My Go Product’s storage media may be erased, replaced and / or reformatted in the course of service.
Following Guarantee service, your My Go Product or a replacement product will be returned to you as your My Go Product was configured when originally sold, subject to applicable updates. My Go may install system software updates as part of Guarantee service that will prevent the My Go Product from reverting to an earlier version of the system software. Third party applications installed on the My Go Product may not be compatible or work with the My Go Product as a result of the system software update. You will be responsible for reinstalling all other software programs, data and information. Recovery and reinstallation of other software programs, data and information are not covered under this Guarantee.
You may seek service in a country that is not the country of purchase, in such a case you will comply with all applicable import and export laws and regulations and be responsible for all custom duties, V.A.T. and other associated taxes and charges.
You must return the original product in the package that contained the replacement product in accordance with the instructions given to you by My Go Technical Support or Authorised Service Agents.
Please do not send any accessories (or Console games/disks) in with your repairs unless we have specifically requested them (e.g. for a power problem we may request the charger or power supply). We cannot be held responsible for any loss or damage to accessories whilst in our possession (SIM cards, memory cards, chargers, boxes, cases, cables, mounts etc.). On occasions we may ask for certain accessories to be sent in after our initial diagnosis for further testing as they may be related to the fault.
Important: Do not open the My Go Product unless the User Manual describes how it is designed for opening. Opening the My Go Product may cause damage that is not covered by this Guarantee.
Privacy
Both of us agree that under this Agreement: 1) all information exchanged is nonconfidential. If either of us requires the exchange of confidential information, it will be made under a signed confidentiality agreement; and 2) any information disclosed or provided to My Go, over the telephone or electronically is not customer proprietary information.
My Go and our related companies will process, store and use information about your transaction and your contact information, including name, phone numbers, address, and e-mail addresses, to process and fulfill your transaction. My Go will not be able to perform our Services if you refuse to provide your information or do not wish us to transfer your information to our agent or contractor.
Where possible My Go will try to assist with chargeable repairs of ‘obsolete’ or ‘discontinued’ products where possible, however it may no longer be technologically possible to service obsolete and discontinued products.

Abuse Towards Staff
My Go Ltd will not tolerate abuse or abusive behaviour towards any member its staff or staff of any authorised third parties in any circumstances. Any incident of abuse (verbal, physical, emotional, financial, mental) will result in either of the following actions being taken: withdrawal of service and possibly reporting to the police or relevant authority. This may include withdrawal of any service offered above the statutory requirements. All staff will report incidents of abuse, however small, to their Line Manager for a decision on appropriate action.
Software Limited Guarantee
My Go Ltd offers no Guarantee, either explicitly expressed or implicitly implied, for any pre-installed software, its quality, performance, functionality, or compatibility for a particular purpose. Nor does My Go Ltd warrant that the functions contained in the software will meet specific requirements or that the operation of the software will be uninterrupted or error-free. Thus, the software is sold ‘as is” unless otherwise explicitly stated in writing.
Obtaining the Guarantee Service
Guarantee service is performed by My Go Ltd authorized service centers on products purchased and located within a country where My Go Ltd or its authorized Service Providers offer the Guarantee service subject to the terms and conditions provided in this International Limited Guarantee.
Guarantee service or Returned Merchandise Authorization under this Standard Guarantee will be honored only if claims are made within the Guarantee period.
The clients are requested to perform the following actions before claiming My Go Ltd product as defective:
D1. Make sure to back up any important data and remove all confidential, proprietary or personal information from HDD, optical, of flash memory storage if necessary. Neither My Go Ltd nor its authorized service centers are responsible for damages to or loss of any programs, data, or other software and files in the storage.
D2. Write down model name, serial number, and problem description. It is highly recommended to register the product failure case with the Go Technical Support service and keep the printout for the records.
D3. Refer to user manual enclosed within the product package and/or information here for important tips on how to operate and troubleshoot the product
D4. Before returning the product for servicing, please reset the system to its default configuration by removing options and external connections, and remove the recently installed software if any.
International Guarantee
Guarantee may be valid when My Go Ltd brand name product is purchased in one country and transferred to another country, where an authorized My Go Ltd service centre is located, without voiding the Guarantee. Please be advised that service availability and response time may vary from country to country.
Guarantee repair service involving language based aspects of your product (e.g. keyboards, software) may not be capable of being performed in another language other than the primary language used in the country where the service request is made.
My Go Ltd is not responsible for any export and import control issues, handling fees, tariffs, import duties, and all other related fees that may be incurred during transferring.
Guarantee Exclusions
My Go Ltd shall not be liable to replace or repair the goods under the terms of the Guarantee where:
1 The fault has been caused or is attributable to accidental use, misuse, negligent use or used contrary to the manufacturers recommendations or where the fault has been caused by power surges, water damages or damage caused in transit.
2 The device has been used on a voltage supply other than an authorised power adaptor.
3 Repairs have been attempted by unauthorised dealers.
4 Where the device has been used for hire purposes/non-domestic use.
5 My Go Ltd are not liable to carry out any type of maintenance work.
6 Smashed or cracked touchscreens or LCD displays are not covered by this Guarantee.
7 Does not cover any subjective or aesthetic aspects of the Hardware Device
Limitation of Liability
My Go does not warrant, represent or undertake that it will be able to repair or replace any My Go Product under this Guarantee without risk to and / or loss of information and / or data stored on the My Go Product.
any losses that were not caused by our breach of this Guarantee document;
any loss or damage that was not, at the time of your purchase of the product, a reasonably foreseeable consequence of My Go breaching this Guarantee document; or
losses relating to any business of yours, loss of profits, loss of data or loss of opportunity.
The provisions of this Guarantee document shall not apply to (i) death or personal injury; (ii) fraud; (iii) fraudulent misrepresentation; or (iv) any other liability that cannot be limited or excluded as a matter of law.
My Go Ltd reserves the rights to refuse Guarantee service of products under disputable conditions. My Go Ltd also holds the rights to declare final decision whether products are within Guarantee conditions. The following actions and damages will result in voiding the limited Guarantee:
• Damage caused by act of nature, such as fire, flood, wind, earthquake, lightning, etc.
• Damage or incompatibility caused by failure to perform a proper installation or to provide an appropriate operational environment for the product, including but not limited to unstable wired/ wireless network connection and phone lines, bad grounding, external electro-magnetic fields, direct sunlight, high humidity and vibration.
• Damage caused by impact with other objects, dropping, falls, spilled liquids, or submersion in liquids.
• Damage caused by unauthorized repair or disassembling of the product
• Damage caused by any other abuse, misuse, mishandling, or misapplication
• Damage caused by third party peripherals (including but not limited to visible damages on motherboard or other electronic parts of the product such as burn spots after electric discharge, melting, fusing, splitting, etc.)
• Any errors caused by software incompatibilities and viruses as well as unauthorized modification of built-in software (including BIOS).
• Deterioration due to normal circumstances including the enclosures, diskette, manuals, and battery packs.
• The serial number of the product (or serial number stickers of its parts) has been modified, removed, blurred or damaged.
• Cracks and scratches on LCD and plastic material as well as other defects caused by transportation, handling or customer abuse.
• The availability of pixel defects within the Class II level prescribed by ISO 13406-2 or other LCD panel defects. Please refer to ISO 13406-2 regarding the details of acceptable LCD panels defects.
• The effects of so-called “image sticking” and faults in brightness on LCD panels caused by fixed pattern pictures displayed for a long period of time (longer then one day).
Exclusion of other damages. To the full extent allowed by law, My Go Ltd are not liable for any:
(I) consequential or incidental damages;
(Ii) damages or loss of any nature whatsoever relating to lost profits, business interruption, loss of data or privacy or confidentiality, any inability to use all or part of the hardware device or software, personal injury, or any failure to meet any duty (including but not limited to any duty of negligence, good faith or of workmanlike effort); or
(Iii) indirect, special, or punitive damages arising out of or relating in any way to the software or hardware device. The foregoing applies even if My Go Ltd or any supplier, affiliate or agent has been advised of the possibility of such losses or damages; and even in the event of fault, tort (including negligence), strict or product liability, misrepresentation or other reason.
This guarantee does not confer any rights other than those expressly set out above and does not cover any claims for consequential loss or damage. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusions many not apply to You. This guarantee is offered as an additional benefit and does not affect your statutory rights as a consumer. My Go Ltd products are intended for consumer use only. My Go Ltd has a policy of continuous improvement in product quality and design and therefore, product specifications are subject to change.
Disclaimer of Guarantee
THIS GUARANTEE IS EXPRESSED IN LIEU OF ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING THE IMPLIED GUARANTEE OF MERCHANTABILITY, THE IMPLIED GUARANTEE OF FITNESS FOR A PARTICULAR PURPOSE AND OF ALL OTHER OBLIGATIONS OR LIABILITIES ON My Go Ltd’S PART, AND IT NEITHER ASSUMES NOR AUTHORIZES ANY OTHER PARTY TO ASSUME FOR My Go Ltd ANY OTHER LIABILITIES. THE FOREGOING CONSTITUTES THE BUYER’S SOLE AND EXCLUSIVE REMEDY FOR THE FURNISHING OF DEFECTIVE OR NONCONFORMING PRODUCTS AND My Go Ltd WILL NOT IN ANY EVENT BE LIABLE FOR COST OF SUBSTITUTE OR REPLACEMENT, COST OF FACILITIES OR SERVICE, DOWNTIME COSTS, LOSS OF PROFITS, REVENUES OR GOODWILL, RELIANCE DAMAGES, LOSS OF DATA, LOSS OF USE IF OR DAMAGE TO ANY ASSOCIATED EQUIPMENT, OR ANY OTHER INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES BY REASON OF THE FACT THAT SUCH PRODUCTS WILL HAVE BEEN DETERMINED TO BE DEFECTIVE OR NONCONFORMING.
This Limited Guarantee gives you specific legal rights. You may also have other rights that may vary from state to state or from country to country. You are advised to consult applicable state or country laws for full determination of your rights.
My Go Ltd products are not designed for any “critical applications.” ”Critical applications” shall mean life support systems, medical applications, connections to implanted medical devices, commercial transportation, nuclear facilities or systems or any other applications where product failure could lead to injury to persons or loss of life or property damage.
GENERAL
No My Go reseller, agent, or employee is authorized to make any modification, extension, or addition to this Guarantee.
If any term is held to be illegal or unenforceable, it shall be severed from this Guarantee and the legality or enforceability of the remaining terms shall not be affected.
Where the product was purchased in Ireland, this Guarantee is governed by and construed under the laws of Ireland and each party hereby submits to the non-exclusive jurisdiction of the Irish courts.
Where the product was purchased in the UK, this Guarantee is governed by and construed under the laws of England and each party hereby submits to the non-exclusive jurisdiction of the English courts, unless you live in Scotland in which case the laws of Scotland will apply.
